No landlord ever wants to be in the position of filing an eviction and going through the court process. There are things you can do to prevent evicting a tenant. A proper screening process will help. You need to have a good policy and adhere to it. At Advantage Asset Management, we do a full background check, a hard credit check, and an eviction history check. We want to fully evaluate a tenant before we move them in and make sure they’re a good fit.
Three Day Notice
No matter how much you screen, you can’t always be 100 percent protected against eviction. Therefore, you want to make sure you have a strict policy in place. We serve a Three Day Notice to anyone who is late with rent. The tenants have three days to pay rent in full or talk to us about a payment plan. We set up payment plans on a case by case basis, but we do recommend that you limit your payment agreement to 30 days. You don’t want to get into the next rent cycle, because it’s difficult for someone to catch up with the late rent and pay the current rent.
Evicting a Tenant
If someone is still not able to pay, and you need to move forward with an eviction, you have to document everything well. Date and time-stamp your Three Day Notice, as well as any agreements you make or other communication. You’ll need to refer to this documentation if the matter goes to court. We recommend hiring an eviction company to file these things on your behalf. They can make sure everything is all done in accordance with local, county, and state regulations and laws. They will even go to court for you if a date is set and someone has to show up. This will save you time and headaches. Eviction is their specialty, so everything will be done correctly.
